Trademark Infringement complaints have become common place on the Amazon Marketplace. Some complaints have merit, others don’t. Today I would like to zero in on one Trademark Infringement complaint I see over and over again, because with just a little attention to detail this complaint is avoidable. I am talking about complaints filed against sellers who believe they have listed against a GENERIC LISTING.

Research, Research……Research than List!

In our experience very few listings are actually generic. Many of the complaints we see pertaining to Trademark Infringement are from small private label sellers. These complaints can lead to immediate ASIN suspensions and in some cases Account Suspensions. So it is important to be vigilant in reviewing and researching any ASIN before listing against it.

While this may sound like a very “beginner’ task, the first thing you must do before listing against an ASIN you did not create is review it thoroughly. Read the title in full, bullet points, item model number and description. Additionally you will want to look at all photos of the product to look for unique packaging and brand names.

If any of this varies even slightly from the product you are about to list you could be opening your account up for a Trademark Infringement complaint or in some cases a counterfeit complaint. So if the packaging is different, or the manufacturer’s model number doesn’t match up, do not list your product against it!

Amazon Policies and Guidelines

Whether you are listing a new product, against a pre existing listing (generic or branded) or selling a “compatible with” product, its always best to review policy first. Amazon has provided ample verbiage to ensure sellers comply with the policies and guidelines set into place.

So do yourself a favor and check out Amazon’s policies before listing a product for the first time on Amazon.
